How We Use Your Information

• To engineer, deliver, and maintain customized digital services, mobile applications, and e-commerce platforms.
• To process invoices, secure payments, and manage ongoing web hosting subscriptions.
• To communicate securely regarding project milestones, technical support, and account approvals.
• AI Implementations (Data Fencing): Any data provided to train or configure Generative AI Agents is used strictly within the secure confines of your specific project. Your proprietary business data is never used to train public foundational AI models.

We may share necessary data with trusted third-party service providers (such as hosting platforms or payment gateways) strictly to operate our business and provide services to you. 2. Terms & Conditions

Acceptance of Terms

By accessing our website or engaging Eddie Digital Solutions for technology services, you agree to be bound by these Terms and Conditions.

Services Provided

Eddie Digital Solutions provides advanced technology infrastructure, including but not limited to:

• Custom Website & E-Commerce Development
• Mobile App Development (iOS & Android)
• Generative AI Agents & Workflow Automation
• Comprehensive IT Services, Support & Hosting
• Digital Services & Pro-Bono Support for Non-Profit Organizations (NPOs)

Project scopes, deliverables, timelines, and costs will be finalized via customized service agreements, proposals, or invoices prior to the commencement of any development work.

Payments and Billing

• All pricing for custom solutions is outlined during the consultation and quoting phase.
• Bespoke web development, app development, and consulting services require a pre-determined financial deposit before development hours are allocated.
• Configuration Cost: A once-off R100 configuration and setup cost applies to all new accounts.
• Monthly Hosting Pricing: Regular websites are R80 per month. E-commerce websites are R99 per month (covering up to 3 websites). If any one of your hosted websites is an e-commerce site, the R99 per month rate applies across the board.
• Final deliverables (administrative access, live-server deployment, app store publication) will only be handed over to the client after full and final payment has been successfully cleared.

Hosting & Migration Policy

• Minimum Hosting Period: You are required to host with us for a minimum of 2.5 years (two and a half years) to cover the initial development cost of the actual website.
• Migration Before 2.5 Years: If you decide to move your hosting to another provider before the minimum 2.5-year period has passed, you may only transfer your domain name and email data. You will not be permitted to take the website files, design, or source code.
• Migration After 2.5 Years: After completing the initial 2.5-year minimum hosting term, you are free to transfer the entire website (including code and design), along with the domain and emails, to another provider.
• CMS Platform Rules: Only e-commerce stores are eligible to be built on WordPress. Regular informational websites will be built using custom code or other platforms at our discretion.

Intellectual Property & Code Ownership (Strict Application)

To ensure we can continually provide high-quality services, we maintain a strict legal separation between your business assets and our proprietary technology infrastructure:

• Client Ownership (The Idea & Assets): You retain 100% unencumbered ownership of your business idea, brand identity, logos, raw user data, generated content, and the unique operational business logic of your company.
• Agency Ownership (The Code & Engine): Eddie Digital Solutions legally retains all copyrights, intellectual property rights, and ownership of the underlying structural source code, AI prompt engineering, development frameworks, and backend architectural models used to construct your platform.
• License to Use: Upon final payment, you are granted a worldwide, perpetual, non-exclusive license to utilize the compiled software and digital assets for your intended business operations.
• Strict Resale Prohibition: You are strictly prohibited from reselling, white-labeling, redistributing, or licensing our raw source code or proprietary backend architecture as a standalone software product to any third party.

Pro-Bono & NPO Services

Digital infrastructure and IT support provided to Non-Profit Organizations at zero cost are delivered on an "as-is" basis. While we strive for excellence in all our community projects, pro-bono services do not carry legally binding Service Level Agreements (SLAs) regarding guaranteed uptime or immediate technical support response times, unless a specific, written agreement dictates otherwise.

Limitation of Liability

While we strive to provide seamless, secure, and robust technological solutions, Eddie Digital Solutions shall not be held liable for any indirect, incidental, or consequential damages. This includes, but is not limited to, loss of data, business downtime, or revenue loss arising from the use of our services, third-party server outages, external cloud providers, or security breaches resulting from client-side negligence.

Revisions and Updates

We reserve the right to modify these policies and terms at any time to reflect changing technological or legal landscapes. Changes will be posted on this page with an updated "Effective Date." Continued use of our website or services after any changes constitutes your acceptance of the new terms.
